K18 Hair Refer-a-Friend Program Terms & Conditions
K18, Inc. (“K18,” “we,” “us,” or “our”) may, from time to time, offer our customers and users of our website the opportunity to participate in our friend referral program (“K18 Hair Refer-a-Friend Program”) and to receive rewards toward future purchases from www.k18hair.com (the “K18 Site”) by referring friends and other individuals.
If you choose to participate in the K18 Hair Refer-a-Friend Program, you are subject to K18’s Terms of Service, Privacy Policy, and the following K18 Hair Refer-a-Friend Program Terms & Conditions:
- Eligibility. Eligibility is limited to individuals who are at least 18 years of age and a legal resident of the United States. The K18 Hair Refer-a-Friend Program cannot be used by corporate entities, businesses, on discount sites, or for affiliate lead generation as determined in K18’s sole discretion.
- Referrer. Individuals who meet the eligibility requirements may participate in the K18 Hair Refer-a-Friend Program by registering at https://www.k18hair.com/pages/refer (each participant, a “Referrer”) and following the instructions to submit Referred Customers. A “Referred Customer” is a person in the United States who arrives to the K18 Site by clicking the Referrer’s unique Refer-a-Friend referral link. By participating as a Referrer, you represent that you are legally permitted to provide us with personal information for each Referred Customer that you submit (such as name and email address).
- Referred Customer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). The Referred Customer must be a first-time purchaser on the K18 Site; referrals over the phone or in person will not be accepted. When a Referred Customer arrives to the K18 Site and makes a purchase that qualifies as a Qualified Referral, the Referred Customer can receive a $10 discount off of their Qualified Referral purchase.
- Qualified Referral. A “Qualified Referral” is defined as a qualifying, first-time purchase made on the K18 Site by a Referred Customer who completes an order greater than $50 in total value, minus all fees including taxes, discounts, shipping, returns, chargebacks, fraudulent payments, and/or other 3rd party fees. Referrers are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals.
- Referral Rewards. When a Referred Customer arrives to the K18 Site and makes a purchase that qualifies as a Qualified Referral, the Referrer will receive a K18 discount code in the amount of $10 (“Referral Reward”). Referral Rewards are one-time-use and subject to change without notice, and may only be used for qualifying purchases made on the K18 Site in United States Dollars. Referral Rewards may not be (i) used for subscription orders; (ii) sold or transferred; (iii) redeemed for cash; or (iv) applied toward previous purchases or the purchase of gift cards. Subject to the terms of the relevant coupon code offer, in some cases Referral Rewards may be used with a coupon code on a single purchase, but may not be combined with any other offers, discounts, or promotions. Each individual Referrer can only obtain a maximum number of fifty (50) Qualified Referrals, for a maximum possible Referral Reward of $500. As a Referrer, you are responsible for any and all tax liability resulting from Referral Rewards. Referral Rewards are determined by K18 and are subject to change at K18’s sole discretion.
- Compliance with Law. You must comply with all applicable laws including, but not limited, the CAN-SPAM Act and other similar laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from the K18 Refer-a-Friend Program. You agree that you will only send your Refer-a-Friend referral link to individuals that meet the eligibility requirements for the Refer-a-Friend Program. You will indemnify and hold K18, its directors, officers, employees, shareholders, agents and successors harmless, from and against any claims that may arise from any unlawful forwarding or sharing of the referral link.
- Privacy; Notice of Financial Incentive. For more information about our privacy practices in connection with the K18 Refer-a-Friend Program, please visit our Privacy Policy. California residents may review the section titled “Notice of Financial Incentive” for more information regarding your consumer data.
- Additional Terms, Conditions, Exclusions, and Restrictions. Additional terms, conditions, exclusions, and restrictions may apply to Referral Rewards or your use of Referral Rewards. We reserve the right to make certain Referral Rewards selectively available to certain customers at any time based on activity, geographical location, program participation or other factors determined in our sole discretion.
- Right to Terminate Accounts. K18 reserves the right to terminate the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the K18 Refer-a-Friend Program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation.
- Right to Cancel Program or Change Terms. K18 reserves the right to cancel the Refer-a-Friend Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed Referral Rewards will be forfeited at that time.
